Reno County District Judge Trish Rose on Friday handed down the standard sentence to Donavan Hall, declining to give a more lenient sentence to the Hutchinson man charged in June with aggravated indecent liberties with a child under age 14.
Hall was sentenced to 59 months in a Kansas Department of Corrections facility. He also will register as a sex offender.
Rose cited concerns about the disparity of the age between Hall and the victim. He was listed as 29 years old at the time of his arrest and the girl was elementary-school age.
“She’s a child, not a young woman,” Rose said.
Also, Rose voiced concern that Hall assigned responsibility to the girl, telling her not to tell anyone.
“It was stupid,” Hall said. “I should never have been alone with her,” he said. Hall said he need help. “If I have to get that done in prison, I will,” he said.
Hall, who has been held in the Reno County Correctional Facility and was wearing jail garb, said he is “avoiding all children as much as I can.”
Hall’s defense attorney said that Hall “has never denied that there was behavior that was not appropriate,” but the attorney pointed out there never were any clothes off and there was never touching of genitalia.
Hall did plead guilty, the prosecuting attorney said, but she said Hall “still doesn’t understand the impact.”
