A man was sentenced in Kiowa County District Court to 20 years in prison for intentional murder in the second degree in the beating death of another man while they were both residents of Haviland Care Center, a residential mental health facility.

Judge Sidney R. Thomas sentenced Brandon Lee Brown, 31, to 240 months in prison for the murder of Jerry Martinez, 62, on May 17, 2015.

Martinez was flown by Life Team to Wichita that night. Martinez died the following June 2 when he was taken off life support. After Martinez’s death, the charges against Brown were amended from aggravated battery to second degree murder.

During a preliminary hearing in Kiowa County District Court in April of 2016, an employee and former employee of the Haviland Care Center testified to witnessing Brown beating Martinez. At the end of the hearing, Magistrate Judge Ann Dixson found there was probable cause to believe Brown had committed the crime.

In October, Brown pleaded no contest to the crime.

C.W. Klebe, with the Kansas Attorney General’s office, assisted Kiowa County Attorney Scott James in prosecuting Brown.
